Terms of Service

1. Acceptance of Terms

By accessing or using Ezpizee's GPS tracking platform, purchasing our devices (FMC920, FMC003), or subscribing to any service plan, you agree to be bound by these Terms of Service. If you are using the Services on behalf of a company, you represent that you have authority to bind that organization.

2. Service Description

Ezpizee provides real-time GPS tracking hardware, a web-based fleet management dashboard, mobile applications, and related analytics services. Our platform processes location data from GPS devices installed in your vehicles to deliver tracking, reporting, and fleet optimization features.

3. Subscriptions & Billing

• Plans: Basic ($5/mo), Pro ($12/mo), and Enterprise (custom pricing) are billed monthly per vehicle
• Device purchases: FMC920 ($59) and FMC003 ($89) are one-time hardware costs, non-refundable after activation
• Free trial: Not currently offered. All plans are month-to-month with no long-term contracts
• Cancellation: You may cancel at any time from your dashboard. Service continues until the end of the current billing period
• Refund policy: Subscription fees are non-refundable. Unused device returns are accepted within 14 days of purchase if unactivated

4. Acceptable Use

You agree to use our Services only for lawful fleet management purposes. You shall not:

• Track individuals without their knowledge or consent where required by law
• Use the platform for surveillance that violates privacy regulations
• Tamper with, reverse-engineer, or modify GPS tracking devices
• Share account credentials or allow unauthorized access to fleet data
• Use the API (Enterprise plan) to build competing services

5. Device Ownership & Warranty

GPS tracking devices become your property upon purchase. Devices carry a 24-month manufacturer warranty covering hardware defects under normal use. Warranty does not cover damage from improper installation, water exposure beyond IP rating, physical damage, or electrical surges.

6. Service Availability

We target 99.9% uptime for our tracking platform. GPS accuracy depends on satellite visibility and cellular network coverage, which are outside our control. We are not liable for tracking gaps caused by device power loss, cellular outages, GPS signal obstruction, or force majeure events.

7. Limitation of Liability

Ezpizee's total liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including but not limited to: vehicle theft despite active tracking, lost revenue, or data loss beyond our reasonable control.

8. Termination

We may suspend or terminate your account for violation of these terms, non-payment, or fraudulent activity. Upon termination, your access to the platform and historical data will be revoked. You may export data before termination through your dashboard.

9. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved through binding arbitration or in the courts of Kuala Lumpur, Malaysia.
